Re : Penang –Perak Bar Games 2009

We refer to the above.

Penang Bar have made arrangements at the Paradise Sandy Beach Resort for our players and supporters during the upcoming Games. Details are as follows:-


Check In : Out Date : 25-26 July 2009

Numbers of rooms : 20 Deluxe Studio Room (Either two single beds or one king size bed No guarantee)
Rate : RM220 nett per room per night, inclusive of breakfast for two

1. All Reservations and bookings must be made before the 6th of July 2009.The Hotel is unable to hold the rooms after this period if there is no confirmation.

Synopsis Of The Talk


Malaysia saw a major overhaul of its arbitral regime with the enactment of the Arbitration Act 2005 (Act 646) which came into force on 15th March, 2006. The Act applies to all arbitrations commenced after that date regardless of when an arbitration agreement is entered into.


It is based on the UNCITRAL Model Law on International Commercial Arbitration, which repeals and replaces the Arbitration Act 1952 (Act 93), and the Convention on the Recognition and Enforcement of Foreign Arbitral Awards Act 1985 (Act 320), which implemented the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958.


The talk will discuss the law by way of an overview of the provisions, changes and practical impact brought about by the 2005 Act. It will examine the tactical, procedural and legal issues relevant to arbitration, consideration of key cases and references to the interaction of the 2005 Act with the arbitral process.


About the Speaker

Sundra Rajoo is a Chartered Arbitrator, Advocate and Solicitor. Earlier, he had practised as an Architect and Town Planner. He has been appointed as chairman, co-arbitrator of three-man arbitral panels and sole arbitrator in international and domestic arbitrations. He is currently a visiting Associate Professor at Universiti Teknologi Malaysia.


He is the founding and current President of the Society of Construction Law (WP & S), past Chairman of the Chartered Institute of Arbitrators Malaysia Branch and past Deputy President of the Malaysian Institute of Arbitrators. He is also a past Council Member of Pertubuhan Arkitek Malaysia. He won the Annual Prize, North-East Branch in 1996 and the Cedric Barclay Prize in 2002 of the Chartered Institute of Arbitrators, United Kingdom.


He is the author of The Law, Practice and Procedure of Arbitration, 2003, The Malaysian Standard Form of Building Contract (The PAM 1998 Form), 2nd Edition, 1999, the Arbitration title of the Halsbury Laws of Malaysia, 2002 which were all published by Lexis Nexis. He also co-authored with WSW Davidson, The Arbitration Act 2005: UNCITRAL Model Law as applied in Malaysia, 2007, Sweet & Maxwell.

GOLFING ANYONE?

To all Golfing Members Perak Bar,

Dear Sirs,

Re : The Annual Malaysian Bar’s Interstate Golf Tournament will be played
at the ORNA GOLF & COUNTRY CLUB on 4th July, 2009 at 1.00pm. (Malacca)

Since this is a team event the respective bodies are requested to field not less than 5 players and the maximum number of players allowed (except for Kuala Lumpur and Selangor) is 15. Kuala Lumpur and Selangor Bar are allowed a maximum of 20 players. Concession will be made to smaller State Bars to join force to make the minimum number.

The mode of play will be system 36 stableford based on the score of the best 5 players. Prizes will be awarded to the top 3 teams and the player returning the best gross score will win the R.R. Mahendran Memorial Trophy. The champion team will take home the coveted Interstate Golf Trophy donated by Mr. P.Suppiah.

Players are requested to liaise with Dalgit Singh at 019-5505747 or 05-2544636 (office) to participate in the event. The green fee is RM200 inclusive of 18 holes green fee, buggy on twin sharing, running lunch, dinner, prizes and may be goodie bag.

Cheques to be made out in “Perak Bar Committee”. Payments are to reach the by 20th June, 2009 to facilitate arrangements. If you need accommodation the Melaka Bar members will assist you in making the necessary arrangements. Hotel bookings will however have to be made directly TO Mr. Dalgit Singh.
