A Report on the Professional Development Sub Committee talk held on 26.5.2010 at the Perak Bar Room between 3.30pm-5.00pm

I have the honour of presenting a report on the above. The speakers were Encik Ahmad Yani b. Aminuddin of Messrs Abbas & Ngan and Mr Edwin Seibel of Messrs Gibbs & Co. The topic presented was entitled “Civil Appeal; Procedure, Practice & Pitfalls. As suggested by the topic, the audience was taken to various pieces of primary legislation, subsidiary legislation, practice directions and authorities on the matter. A 30 page booklet entitled “Guidelines on Procedure for Appeal in Malaysian Civil & Criminal Courts” complete with an Annexure also prepared and distributed to the audience.

I must say that the talk was well attended and also well received. The audience exceeded expectation by 20% which resulted in the shortage of the aforementioned booklet before our Encik Zaizuraimy’s timely instruction to have it further copied even when the talk was in progress.

I must express my gratitude to the speakers and Ms. Chia Yuh Ning who has taken time in their busy schedule and effort in presenting the talk. It is my hope that for the talk scheduled on 18.6.2010 on 2 aspects of criminal matters would also be well received.

PERAK BAR - MBI FAMILY DAY 2010 - LEGAL AID REPORT

LEGAL AID BOOTH AT PERAK BAR’S FAMILY DAY

Perak Bar celebrated its family day on Saturday, 22^nd. May at the Polo Ground in Jalan Tambun.  If I am not mistaken this was the very first time it was jointly organised by Dewan Bandaraya Ipoh.  Although it started of wet and muddy as a result of the impending rain, nonetheless entertainment and simmering hawker-style food made it an eventful one.   Staff of DBI, members of Perak Bar and their families were in attendance.

The event was officiated by the Mayor of Ipoh City .  In his speech he pledged to make this an annual affair.  Later, accompanied  by the Chairman of Perak Bar and Committee members, the Mayor visited the various booths on display.  During his stop-over at the Legal Aid Booth, he was informed of the aim/objectives and the role Perak Legal Aid Centre plays in assisting the poorer communities in Ipoh.  There were 11 consultations during the function.

With songs, dances, sports and games the event was a success despite the weather condition which may have prevented  visitors and regular joggers from partaking,  but our spirit was not dampen at all.

Perak Bar vs. Doctors Golf Report

LAWYERS WERE GRILLED ON THE FAIRWAYS

Often we read in the newspapers that doctors were grilled by lawyers in court. But today, the story was different. Our golfers were beaten by the doctors at the Royal Perak Golf Club Ipoh and deservedly grab the “Chairman’s Cup”, the challenge trophy sponsored by the Perak Bar’s Chairman.

It was mutually agreed by both teams that this event will be an annual event which will be held on 23/5/ every year. To all the Perak Bar golfers, hold your head up high and don’t be afraid of the doctors, next year.

PERAK BAR - MBI FAMILY DAY 2010 REPORT

On 22nd May 2010 was the "Pestaria dan Hari Terbuka anjuran Jawatakuasa Peguam Perak bersama Majlis Bandaraya Ipoh" held at Polo Ground. Despite, the morning heavy downpour the turnout was great. There were  about 14 food stalls; 5 of which were manned by members of the bar. The drink and ice cream stalls were exclusively manned by the social sub committee members.  There were 6 corporate bodies which comprises of banks, insurance companies, telecommunication and publication company who had  joined us. We were also very privileged as the Insolvency Dept and Rakan Cop had set up their booths there.

We also have colouring contest for the children which were also open to public and we were very proud to discover talents from our very own members' children.

This event was officiated by our Mayor Dato' Hj Roshidi Bin Hj Hashim. In his speech he has expressed his intentions to make this Open Day a yearly event and has agreed to provide a yearly fund of RM5000 in addition to the equipment and services provided to the Perak Bar Committee for such event.

The band and performances were courtesy of Majlis Bandaraya Ipoh but the highlight was the performance of our very own Bhangra King.

The grand finale was the tug-of-war between the members of the bar and Majlis Bandaraya Ipoh. Although, victory was in the hands of Majlis Bandaraya Ipoh, our members put up a very tough fight (considering the members who participated were half the sizes of their opponents!).

I would like to personally thank everyone who has supported and contributed their time, energy and money to make this event a success. Especially to my social sub committee members for their selfless effort in selling the coupons and organizing the booths; to the main committee members whom have also been allotted a certain number of coupons to sell; to all members who attended especially the senior members who stayed on thru rain and shine; to the photographers for those wonderful shots; the junior members and pupils who helped manned the stalls and last but not least to my boss and jr boss for allowing me time outs from work.

Perak Bar - MBI Family day

Dear Members,

As you can see, the family day was a great success. Kudos to Pn. Zaireen and her sub committee for the successful family day. A big thank you also to the participants as well as to CIMB Bank, Maxis, Insolvency Office, PDRM, Bank Rakyat and also the Legal Aid Bureau for their participation.

As you can see from the picture above, the members are tallying up the coupons to see if a profit has been made or not. The main thing is that the members had fun at the family day!

Good job! And Well done to all involved :) See you again next year? :)

A talk entitled:  Civil Appeals;  Procedure, Practice and Pitfalls* will be delivered by our very own Mr. Edwin Seibel and Encik Ahmad Yani Bin Aminuddin on 26.5.2010 at Perak Bar Room, No. 41, Jalan Dato Maharajalela, 30000 Ipoh, Perak at 3:30pm.

Members are invited to attend.  This topic has been selected after listening to request especially by younger members of the Bar asking for talks of relevance to practitioners.

ps.: In the month of June 2010, there will be a talk by Assoc. Prof. Talat Mahmood Bin Abd Rashid from the Law Faculty of University Malaya broadly on:

(i)  the application of Sec 51 and 51A of the Criminal Procedure Code ;

(ii) Incompetence of counsel as a ground of appeal to set aside a conviction in a criminal matter. 

These 2 topics would naturally revolved around the Federal Court decisions in PP vs Dato’ Seri Anwar Ibrahim [2010] 4 CLJ 331 and Shamim Reza Abdul Samad vs PP [2009] 6 CLJ 93.

The appeal and leave application for appeal to Federal Court will be considered in another session.

Perak Bar Closed Sports 2010; SR v JR

Experience rules over Exuberance

A week has passed. Seniors were proven to be the outright winner throughout all 5 sports played. Juniors however managed to conquer 2 final events . In football they scored 3 goals against the seniors. All the goals were scored in the second half. Netball was a tough fight whereby Juniors won by 9-8. Yes, it was proven that in both physical games, the juniors had edged the seniors.

However, in volleyball and badminton, it was way too easy for the Seniors. The juniors were not only inferior in terms of experience but was also lack of mental strength when they were easily scared away by the all the psycho games by the seniors. In bowling, the seniors were already the winners before the game was even played due to their punctuality and numbers of bowlers who turned up. As a result, seniors won by majority of 601 pins fall.

I would like to thank all my sub committees for the support, all the sponsors, Mr Chairman for sponsoring the Challenge Trophy, all the participants, supporters and everyone who make this event successful. I sincerely hope that this event will be an annual event and perhaps few other games will be added to determine the real winners
