Report on Talk by Associate Professor Talat Mahmood on 24/9/2010

Report on Talk held on 24.9.2010 at Perak Bar Secretariat at 3.30pm.

A talk on application of Sections 51 & 51A of the Criminal Procedure Code and the recently introduced ground of appeal on incompetence of counsel as a ground to set aside a criminal conviction was held as above. Our distinguished speaker on this occasion is Assoc. Professor Talat Mahmood bin Abd Rashid from the University of Malaya with our very own Mr Baldip Singh serving as moderator . Around 30 lawyers primarily criminal practitioners and pupil in chambers were present. The Professor made a power point presentation with references to :-

1. various case law on the matter decided in Commonwealth Countries including Hong Kong and England;
2. the position of law before the introduction of section 51A of the CPC its application in practice and benefits.

Naturally, as all talks with members of the various there was a little Q& A session at the end of the sessions. Questions ranged from the correctness of the PP v DSAI [2010] 4 CLJ 331 to applicability of S 51A CPC to the Toeh Beng Hock inquest.

TALK ON S.51 and S.51A OF THE CRIMINAL PROCEDURE CODE

THE TALK HAS BEEN SCHEDULED FOR THE 

24/9/2010 @ 3.00PM

AT THE PERAK BAR SECRETARIAT

A talk by Associate Professor Talat Mahmod of University Malaya will be held on 24.9.2010 at the Perak Bar Secretariat at 3.00 p.m.

This talk will broadly concern the following topics:-

(i)                              The application of S. 51 & 51A of the Criminal Procedure Code ; and

(ii)                            The recently introduced “new” ground of appeal on the incompetence of counsel as a ground to set aside a Criminal Conviction.

These topics would naturally revolve around the recent Federal Court decisions in PP v Dato’ Seri Anwar Ibrahim [2010] 4 CLJ 331 and Shamim Reza Abdul Samad v PP [2009]6 CLJ 93.

As with the talk held on 26.5. 2010, this topic is selected on the primary basis of their relevance to practitioners especially our members litigating Criminal matters.

Report on Talk on Civil Appeals; Practice and Pitfalls

A Report on the Professional Development Sub Committee talk held on 26.5.2010 at the Perak Bar Room between 3.30pm-5.00pm

I have the honour of presenting a report on the above. The speakers were Encik Ahmad Yani b. Aminuddin of Messrs Abbas & Ngan and Mr Edwin Seibel of Messrs Gibbs & Co. The topic presented was entitled “Civil Appeal; Procedure, Practice & Pitfalls. As suggested by the topic, the audience was taken to various pieces of primary legislation, subsidiary legislation, practice directions and authorities on the matter. A 30 page booklet entitled “Guidelines on Procedure for Appeal in Malaysian Civil & Criminal Courts” complete with an Annexure also prepared and distributed to the audience.

I must say that the talk was well attended and also well received. The audience exceeded expectation by 20% which resulted in the shortage of the aforementioned booklet before our Encik Zaizuraimy’s timely instruction to have it further copied even when the talk was in progress.

I must express my gratitude to the speakers and Ms. Chia Yuh Ning who has taken time in their busy schedule and effort in presenting the talk. It is my hope that for the talk scheduled on 18.6.2010 on 2 aspects of criminal matters would also be well received.
