Re : “Notis Pemberitahu” dated 10-5-2012 from PTG Further to our circular of 11-5-2012, we are pleased to inform that the PTG has accepted our suggestion to permit presentation of subsidiary instruments (eg : Charge) accompanied by **certified true copy of the Sijil Setem in respect of the principal instrument (eg : Facility Agreement) and the “Hasil Carian Pengesahan Ketulenan No. Adjudikasi”. **Note : The certified true copy must be by an Advocate & Solicitor together with rubber stamp bearing his/her full name. The “Hasil Carian” may be dwnloaded from the e-Taksiran website wherein one just fills in the No. Ajudikasi and No. Sijil Setem and then click “Carian”.

Notis Pemberitahu” of 10-5-2012 from PTG

To Perak Bar Members, Re : “Notis Pemberitahu” of 10-5-2012 from PTG Requirement (i) – original Sijil Setem Upon being made aware of the above Notis (attached herewith), the Conveyancing Sub-committee has met the LHDN and Puan Rosziana (Timbalan Pendaftar PTG) yesterday and this morning urgently to explain to the PTG that their requirement (i) in the said Notice is impossible of compliance. We had offered them a couple of alternatives as to how PTG could ascertain that ad valorem stamp duty had indeed been paid on the principal instrument – to which Puan Rosziana is receptive but requires further discussion at their internal meeting. In the meantime, the following has been agreed between us and PTG :- i. PTG will NOT reject subsidiary instruments (eg : Charge) presented from 14-5-2012 without the principal instrument’s original Sijil Setem, but will instead suspend those instruments, pending their decision on whether to accept the alternatives suggested by us ; In case any member has instruments rejected for this reason (as well as members who have had instruments rejected today), you are to bring it to the attention of Puan Rosziana, who will direct the PTG staff to accept the documents which will however be suspended as aforesaid. Puan Rosziana has agreed that PTG will discuss this matter urgently within the next week and will revert within next week. Pending their decision, Members may wish to withhold presentation of affected instruments (except in cases of urgency in which case the instruments will be suspended as aforesaid). Requirement (ii) PTG had clarified that this does NOT mean FAs may not be stamped ad valorem, but merely that the Charge/subsidiary instrument (in cases of manual franking) must be endorsed. Therefore this 2nd requirement is a non-issue.

World Women's Day on 07th April 2012


In conjunction with World Women Day 2012 organized by the Jawatankuasa Industri Pelaburan, Pembangunan Usahawan, Pelancongan Dan Hal Ehwal Wanita, Perak Bar was given the honor to present a paper wherein two speakers will be presenting on topics relating to women to the public. The suggested topics are as such :
(a) Matrimonial violence against women;

(b) Single mothers and their plight & children; and

(c) Battered women.

Training For Lawyers Registered with National Legal Aid Foundation

Re: Training for Lawyers Registered with National Legal Aid Foundation

Thank you for all those who have registered with the Yayasan Bantuan Guaman Kebansaan (YBGK)  / National Legal Aid Foundation (NLAF).

We are pleased to inform you that the Ad Hoc Committee on the NLAF will be conducting a Training for all lawyers who have signed up.  This training is designed to equip lawyers with the necessary information and skills to assist and represent those in need of legal representation in criminal proceedings under the YBGK/NLAF scheme.

The training consists of two parts.

Part 1 – NLAF Administration and Procedures (tentatively 9am to 1 pm)

1.   Standard operating Procedures
2.   Claims Procedures
3.   Payments Schedule &
4.   Other Administrative Procedures.

Part II – Training on Criminal Law ( tentatively 2 pm to 5 pm)

1.   Arrest
2.   Remand
3.   Bail &
4.   Mitigations

The Training will take place as follows:

Date     :  16.04.2011 (Saturday)
Time    :   8.30 am to 5.00 pm
Venue  :   Hillcity Hotel, Jalan Dr. Nazrin Shah (Jln. Gopeng), Ipoh

BAR COUNCIL ETHICS COURSE FOR NORTHERN REGION

Dear Members,

Bar Council Ethics Course for the Northern Region will be held at the Bayview Hotel Georgetown, Penang on Friday (13th May 2011) from 8.00 a.m. to 5.30 p.m. and on Saturday (14th May 2011) from 9.30 a.m. to 12.30 p.m. at a cost of RM150.00 per pupil.

This will be followed by a compulsory lunch on Saturday (14th May 2011) at the Sri Delima, Level 4, Bayview Hotel, Georgetown, Penang.

Briefing on Yayasan Bantuan Guaman Kebangsaan in Taiping

Advocacy Training Course

To members of Perak Bar,

Re : Advocacy Training Course on (26th and 27th March 2011)


The above matter refers.

Kindly be informed that the Bar Council will be organising the 2nd Advocacy Training Course (ATC) at at the Kuala Lumpur Court Complex on 26th and 27th March 2011. Kindly refer to the Bar Council Circular No. 052/2011 on the Malaysian Bar Website; the contents of which is self explanatory.

Pursuant to same, the Perak Bar Committee will sponsor the participation fee of RM500.00 per person for 5 young lawyers. The eligible young lawyers are those who are in their first to third years of practice. However the sponsorship will not cover the cost of accommodation and travelling.

Please take note that successful applicants will be required to prepare a report in respect of the said course (ATC). The said report is will be published at the  Perak Bar blog. Further, the successful applicant will  also be required  to serve for one term under either one of the sub-committees.

Briefing on Yayasan Bantuan Guaman Kebangsaan

          
Salam sejahtera.

The Yayasan Bantuan Guaman Kebangsaan (YBGK) will be officially launched by the Prime Minister at 9 am on 25 February 2011. The YBGK will provide legal assistance to all Malaysians at the police station, the remand hearing and when they are charged in court. (in line with s28A CPC).  The scheme is only for criminal cases (syariah as included).

Insofar as hearings are concerned legal assistance will only be provided to those who pass a means test.  Lawyers who do YBGK work will be remunerated according a scale which will be dissussed at the briefing.

The YBGK will need to work closely with the Bar Council Legal Aid Centres in order to provide this legal assistance.  We thus need to have an indepth discussion with representatives of all Legal Aid Centres about the YBGK and how this new system will operate.

It is for this reason that the Chairman Haji Mad Diah Endut would like to meet and brief volunteers practising criminal law.  The briefing and discussion will take place as follows:

Time              : 3 pm - 5 pm
Venue           : Conference Room, 1st Floor, Perak Bar Secretariat,
                                     Ipoh.
